How can CAD help with background checks?
CAD is owned and operated by Attorney Rob Sakovich. Rob is an associate at Scaringi Law in Harrisburg, where he focuses his practice on state and federal firearms law. Does my criminal history impact my Second Amendment rights?
If you have been convicted of a crime under any state or federal law – whether convicted after a trial or a guilty plea, and whether you served any time in prison or not – you may have forfeited your Second Amendment rights for life. If you provide an accurate picture of any and all felony, misdemeanor, and summary offenses, CAD can help determine whether your rights are impacted and whether there is a route to restoring your rights with competent counsel.
What is a “misdemeanor crime of domestic violence?”
There is no clear definition of this phrase in the federal Gun Control Act. But, if you provide relevant details like the grading of your offense, your guilty plea colloquy if applicable, and the circumstances underlying your arrest, CAD will provide guidance based on the most recent case law defining this confusing term, and we can help you find appropriate counsel to analyze further or restore your rights.
Will my hospitalization result in a denial?
Voluntary mental health treatment is not an impediment to exercising your Second Amendment rights. However, if you were admitted under any state’s involuntary treatment statute for even a moment, whether you knew or not, you are prohibited by both state and federal law. If there is any doubt, CAD will refer you to counsel for a consult to discuss your options under attorney-client privilege.
Does CAD charge for Pre-PICS Assessment?
Absolutely not! We will never take a fee for educating the public on Second Amendment rights!
Can CAD guarantee PICS/NICS approval?
Nobody can guarantee approval of a purchase before the submission of ATF Form 4473. There may be information in the database which you are not aware of, such as a childhood commitment to a mental health hospital, or your identity may be confused with another, properly prohibited person. CAD offers no guarantee regarding outcomes. Our goal is to reduce the stresses of each purchase and avoid submission of paperwork for persons who are obviously prohibited.
